The case and exceptions presented in this case are not very intelligible for the *580purpose of presenting any questions of law, consisting as they do of a mere and literal transcript,, apparently, of the attorney’s or referee’s minutes of the evidence, and full of objections and exceptions on both sides. The action was originally commenced in a justice’s court, to recover a balance due on a note made by the defendant and payable to the order of one Underwood.
