¶ 9.1 concur with the majority’s analysis that Brown is time barred from pursuing his post-conviction relief (PCR) petition under Mississippi Code Annotated section 99-39-5 (Supp.2011) with no applicable exceptions; however, I write separately to address an unspoken concern fundamental to this Court’s authority to even address Brown’s PCR petition on appeal.
