TURNER, O. J.

This is an action in replevin brought by the defendant in error, L. F. Lacey, against the plaintiff in error, I. B. Speieher, in the district court of Pawnee county to recover 40 bushels of wheat in the stack, 300 bushels of corn in a crib, and 300 bushels of com standing in the field; all on a certain piece of land described in the petition, situate in Pawnee county. After general denial filed, there was trial to a jury and judgment for plaintiff, and defendant brings the ease here.
