“This suit was originally commenced in the district court of Leavenworth county, by defendant in error against plain*17tiff in error, to recover five thousand dollars damages for injuries received to his right arm, in July 1874, while drawing tickets, blindfolded, from a wheel, alleged to have been revolved under the direction of the plaintiff in error, while engaged in a supposed charitable enterprise—raising funds for the purpose of erecting a building for a juvenile reform school in…
