This was an action of assumpsit, by Sage, against the railroad company, to recover for money paid for surveying done before the company was organized or its charter granted, and for services and expenses as director of the company, and for $1000 due on an account stated.
A reeovery was had for $1000, which, under the evidence, must have been upon what was found to be an account stated. The defendant appeals.
On the trial below, the plaintiff offered in evidence the following :
