AMENDED MEMORANDUM OPINION1

Defendant Jennison Toussaint is facing trial on charges of aggravated assault and battery, assault in the third degree, and using a dangerous weapon during an assault in the third degree. The charges stem from an incident the People allege occurred on September 10, 2010. According to the People, Toussaint placed a gun against the head of his former girlfirend, Tinashei Phillips, during an argument and then struck her head with the firearm.
