This action was instituted by plaintiff Frances I. Ebbinghouse, widow of insured, as beneficiary of an insurance certificate issued by defendant to Oscar H. Ebbinghouse.

At the close of plaintiff’s case, tried to a jury, defendant moved for a nonsuit which was denied. At the conclusion of the trial, defendant challenged the sufficiency of the evidence to sustain the verdict in favor of plaintiff. The court denied the motion. Thereafter, the jury returned a verdict for plaintiff. Defendant then presented motions for judgment notwithstanding the verdict, or in the alternative for a new trial.…
