In a proceeding pursuant to CPLR article 78 to review a determination which demoted the petitioner from the position of probationary Assistant Station Supervisor to Railroad Clerk, the appeal is from an order and judgment (one paper) of the Supreme Court, Kings County (Douglass, J.), dated November 7, 1985, which, inter alia, annulled the determination and reinstated the petitioner to his position as an Assistant Station Supervisor.
Ordered that the order and judgment is reversed, on the law, with costs, the determination is confirmed, and the proceeding is dismissed on the merits.
