In August 1985, plaintiff United States of America brought an action under the Comprehensive Environmental Response Compensation and Liability Act (“CERC-LA”), 42 U.S.C. §§ 9601-9657 (1982), seeking reimbursement of response costs for the clean-up of hazardous wastes at the Sealand disposal site in Delaware.
