Appeal from judgment of the General Term of the Superior Court in the city of New York, affirming an order of Special Term staying all proceedings upon the part of the plaintiffs in this action. This action was brought to recover damages for the loss of plaintiffs’ goods destroyed by fire on board of one of defendant’s ships, alleged in the complaint to have been occasioned through the “ mere negligence and carelessness of the defendant.”

Appeal from an order of the General Term of the Superior Court of Hew York,-“ that all proceedings in this action on the part of the plaintiffs be and the same are hereby stayed.”

This action was to recover against the defendant for the loss of goods it had assumed to transport from Providence to Hew York. It had been pending some four years, and had once been tried and was again o'n the calendar for trial when this order was made.
