This was an action brought by appellee against appellant to recover on a life insurance policy issued to her husband and in which she was designated the beneficiary. The original complaint consisted of four paragraphs, a demurrer to the third was sustained, and after the evidence had all been introduced, the court instructed the jury to disregard the first and second, for the reason that the evidence did not support either of these paragraphs.
