The matter under consideration in this Chapter 11 case is a motion to vacate the automatic stay filed by Joseph T. Macari (“Macari”), landlord of the premises of Lew Mark Cleaners Corporation (“Lew Mark”), the debtor herein. Macari seeks relief from the stay to allow him to proceed upon a warrant of eviction, issued pre-petition, to recover possession of a non-residential leasehold located at 149-09 and 149-11 Union Turnpike, Flushing, New York.
