HATCHETT, Justice.

This appeal is taken from a judgment of conviction[1] entered in the County Court of Wakulla County. The prosecution began with a complaint[2] accusing appellant of a violation of Section 847.05, Florida Statutes (1975), which provides:

Any person who shall publicly use or utter any indecent or obscene…
