This is an appeal from the district court of Pannin county. So much of the petition as we deem at all essential in the consideration of the case is substantially as follows:
That the defendant is indebted to the plaintiff in the sum of one hundred and twenty-five dollars, lawful money; that on the 16th day of August, 1839, the defendant made his certain promissory note in writing, jointly and severally with one Spencer Asbury, signed with the proper hand of the said defendant, as well as of the said Spencer Asbury, and then and there delivered the said promissory note to petitioner, which…
