LATTIMORE, Judge.

Appellant was convicted in the District Court of Upshur County of forgery, and his punishment fixed at two years in the penitentiary.

The indictment contained two counts, one for forgery and the other for passing a forged instrument, but only the former was submitted in the court’s charge to the jury. The conviction was for forging the name of J. W. Bowden to a check for $315 which was drawn on the Merchants and Planters State Bank of Winnsboro. Winnsboro is in Wood County. Said check was payable to the order of J. H. Cobit, and was delivered by appellant to Mr. Allen, Cashier…
