KRUEGER, Judge. —

The appellant was tried and convicted of the offense of unlawfully transporting intoxicating liquor, and his punishment assessed at confinement in the state penitentiary for a term of two years.

The facts, briefly stated, are as follows: On the 9th day of April, 1933, while the appellant was traveling in a Ford coupe on Jefferson Highway, No. 65, in Upshur County, he was stopped by some officers.
