OPINION

By MACK, J.

Francis E. Stapleton, an employee of the Nash Company, died July 11, 1938, as the result of an injury received in the course of and arising out of such employment. He left surviving him his daughter, plaintiff herein. Her application for compensation as a depend-ant of deceased was denied by the Industrial Commission for the reason that the proof did not establish dependency. Upon this, her appeal, a jury was waived and the case has been submitted to the court upon the transcript, which covers only six pages of evidence.
