MEMORANDUM OPINION GRANTING SUMMARY JUDGMENT IN FAVOR OF FWB BANK

The court has before it Cross Motions for Summary Judgment filed by FWB Bank (“FWB”) and the Chapter 7 trustee. The parties request this court to summarily decide whether FWB has a perfected security interest in the debtors’ account at Shearson Lehman Brothers, Inc., (hereinafter, the Shearson account).
