Porter, J.:

On June 23, 1910, the appellees commenced three'separate actions against appellants. The pleadings in each were alike and asked for the recovery of one-twelfth- of a half section of land in Ellsworth county, and for the same proportion of the rents and *352profits for three years next preceding. The appellees are the children of Oliver W. Olson- and Alma Olson and their contention is that Alma Olson, who died intestate in 1902, was the owner in her lifetime of an undivided one-half interest in the lands and that they inherit from her.
