The landlord brought this proceeding against the tenant, as the parties are therein nominated, for non-payment of rent for December, 1925, and January, 1926. Upon the trial it appeared that the petitioner in January, 1925, obtained a deed to the property from C. Pianisani, Inc., a corporation controlled by the tenant; that the latter occupied the premises in question at the time of the conveyance and was still in possession at the time of the trial.
