This was an action of assumpsit by plaintiff in error, against defendant in error, on a benefit certificate issued by defendant in error to Philip P. H. Cronin for the benefit of his brother, John J. Cronin. The defense was that the insured was not in good standing in the order at the time of his death, (which occurred May 4,1889,) by reason of his failure to pay assessment No. 17, regularly levied, and due notice thereof given him on January 1,1889.
