Appeal by the defendant, John W. Wilson, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 17th day of May, 1901, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 27th day of May,.1901, denying the defendant’s motion for a new trial made upon the minutes.

Hatch, J.:

The action was brought by the plaintiff as receiver of the Life Union, a co-operative or assessment insurance corporation, to recover a sum of money received by the defendant which the receiver claims equitably belongs to it.

The defendant was for a time acting as a director of said insurance corporation, and during that period three agreements were entered into, which had for their purpose the unlawful transfer of the control of the Life Union over to one Louis P. Levy. This contemplated transfer was a private affair in which certain directors were interested and the money…
