COMPTON, J.

Petitioners Kathryn Kampner and Thomas Joseph Kampner contend that the board erred in annulling the assessment of a 10 percent penalty, pursuant to Labor Code section 5814, against respondent Holiday Inn, Inc. (Holiday Inn) for delay in paying the proceeds of a settlement between petitioners and Holiday Inn.
