The defendant is a deported alien and a native of Peru who now resides in Colombia. On September 11, 1991, the defendant was arrested and charged with criminal sale of a controlled substance in the third degree, criminal possession of a controlled substance in the third degree, and criminal possession of a controlled substance in the fifth degree, violations of Penal Law §§ 220.39 (1); 220.16 (1), and 220.06.
