The German Coal Company, a domestic corporation organized under the general Incorporation act, for the purpose of “mining and selling coal, ” filed a petition under the Eminent Domain act, in the county court of Peoria county, for the-purpose of acquiring, by condemnation, the right of way over a narrow strip of land belonging to the appellant, Adam Sholl, and lying between the company’s coal works and the Peoria and Pekin Union railroad.
