This was an action of ejectment; commenced by Bertha J. Bain, in the district court of Lyon county, to recover the possession of about an acre and a half of land from the defendant, Arthur Peyton. These parties owned and occupied adjoining tracts of land, and disagreed as to the location of the boundary-line between them. On account of this disagreement each claimed to be the owner of the strip of land in controversy.
