POLLACK, District Judge.
This suit was tried to the Court at a bench trial and seeks equitable relief and damages in respect of lost employment with a public educational institution.
Jurisdiction hereof is posited on 42 U.S.C. § 1988 and 28 U.S.C. §§ 1331, 1343(3). The facts are as follows:
The plaintiffs are eight former members of the City University of New York (CUNY) instructional staff who lost their positions in a retrenchment program implemented by CUNY in 1976 in response to the financial exigency created by state-mandated budget cuts.
