This is an action by M. S. Crossen against E.W. Oliver to recover the possession of real property. The plaintiff claims under a deed from Mrs. M. M. Caldwell, dated January 25, 1895, and recorded February 27, 1896 ; and the defendant claims title from the same party by sheriff’s *516sale under an execution issued upon a judgment rendered in favor of Turner Oliver and against Mrs. Caldwell April 2, and docketed April 4, 1895.
