MAUS, Judge.

At the outset it must be observed that it is within the province of this court to take notice of matters not before the trial court that cause the disposition of this appeal to be moot. State v. Brookshire, 377 S.W.2d 291 (Mo.1964). This court has received a copy of an opinion of the United States Court of Appeals for the Eighth Circuit in Thompson v. Armontrout, 808 F.2d 28 (8th Cir.1986).
