(dissenting). Grave considerations of public policy as well as sound and well-settled legal principles, it seems to me, require that this court not disturb the opinion delivered in this case on April 19, 1927, and reported in 126 Okla. 12, 257 P. 761.

This is a second appeal in this cause to this court from judgments of the district court of Nowata county.
