The appellees here, as plaintiffs below, brought their action to- have a certain contract or agreement, hereinafter referred to, reformed, and as reformed specifically performed, and for damages.

The allegations of the complaint were, in substance, that Parle and Bell, on December 31, 1904, entered into a contract or agreement wherein and whereby it was provided that Parle should transfer to Bell a tract of land situate in Morgan county, together with certain water rights, in exchange for a stock of merchandise which Bell was to transfer by hill of sale to Park.…
