By chapter 89, art. 3, Kentucky Statutes, Lexington is designated as a city of the second class. Section 3212 of tbe statute provides- for the maintenance of a system of *642public schools in that city under the control of a board to be styled the “board of education,” consisting of two trustees from each ward of the city; and the appellant board of ■education was created in this way.
