I. INTRODUCTION AND BACKGROUND
Eileen, Steven, and Michael Kuperstein (“the Kupersteins”), all New York residents, brought this action on February 24, 2006 in the Supreme Court of the State of New York, County of New York, alleging injuries to the infant Michael caused by a prescription drug, Lariam. 1 The Kuper-steins bring a number of state law claims against Hoffman-La Roche, Inc. and Roche Laboratories, Inc.
