Plaintiff, Tze-Kit Mui (“Plaintiff’ or “Mui”), has brought suit against his former employer, the Massachusetts Port Authority (“Defendant” or “Massport”). Mui claims that Massport violated the Massachusetts Wage Act (the “Wage Act” or the “statute”), G.L.c. 149, §148, by failing to compensate him for accrued but unused sick leave at the time of his retirement. Massport now moves to dismiss Plaintiffs Amended Complaint, arguing that paid sick leave does not constitute a compensable “wage” under the statute.
