Plaintiff Thomas M. Mattiee, M.D. filed this action against Defendant Memorial Hospital of South Bend (“Memorial”) alleging employment discrimination under the Americans with Disabilities Act (“ADA”). Memorial moved for a protective order regarding, documents it believes are privileged under the Indiana Peer Review Act. Dr. Mattiee responded to Memorial’s motion and filed a motion to compel the documents Memorial claims fall under the peer review privilege.
