Prior to January 5, 1911, plaintiff and his brother were copartners in a business which was conducted by them in the village of Keeseville, county of Clinton, in this state. The partnership was dissolved on that day. The former sold his interest therein to .the latter, and took a chattel mortgage for $900 on the merchandise in payment. The merchandise remained in the possession of the mortgagor.
