This Court granted leave to determine whether the presidential selection procedure utilized by defendant violated the Open Meetings Act (oma), MCL 15.261 et seq.-, MSA 4.1800(11) et seq. Also at issue is whether application of the oma to committees formed by the governing boards of our *96public universities to assist in the selection of university presidents is constitutional.

I respectfully disagree with the majority’s decision to bypass the question whether the OMA was violated. That question must necessarily be answered before addressing whether application of the OMA to defendant is…
