Certiorari issued out of the Supreme Court and attested on the 1st day of July, 1905, directed to William McAdoo, as police commissioner ot the city of New York, commanding him to certify and return to the office of the clerk of the county of Kings all and singular his proceedings had in relation to the dismissal of the relator from the police force of the city of New York.

This is a proceeding by certiorari to review the action of the respondent in dismissing the relator, a patrolman, from the New York police force. The dismissal was on March 2, 1905. ■ Section 302 of the charter of Greater New York (Laws of 1901, chap. 466) provides that no proceeding shall be brought to procure the restoration or reinstatement of a police officer “ unless said proceeding shall be instituted within four months after the decision or order sought to be reviewed.” July second, the last day of the four months so allowed, fell on Sun*674day.
