McCormick v. Ornstein
Court of Appeals of Arizona
1Opinion of the Court
OPINION
HOWARD, Judge.
The issue in this case is whether appellee had the right to rescind his contract for the purchase of a custom-made trailer. The facts considered in the light most favorable to supporting the judgment are as follows.
Ornstein contracted with McCormick for the construction of a custom built trailer to be used in Ornstein’s wholesale nuts, bolts and fasteners business to bring merchandise to the door of the customer. McCormick knew the purpose of the trailer and also that Ornstein was going to equip the interi- or with bins and racks for carrying the merchandise.
