Rosalinda DeLeon, Gilberto DeLeon, III, and Leobardo Garcia-Duarte (collectively, “Appellants”) were tried together and each convicted of one count of conspiracy to transport illegal aliens in violation of 8 U.S.C. § 1324(a)(l)(A)(v)(I) and (B)©. 1 Appellants contend that the district court erred in instructing the jury because: (1) it failed to set out the substantive elements of the crime in the application portion of the jury instructions; (2) it failed to instruct the jury that one of the co-conspirators must have committed an overt act; and (3) the indictment and the jury…
