Appeals (1) from a judgment of the County Court of Clinton County (McGill, J), rendered March 15, 2004, upon a verdict convicting defendant of the crime of assault in the second degree, and (2) from a judgment of said court, rendered April 29, 2004, which resentenced defendant.

Defendant, an inmate, was charged with assault in the second degree after he punched a correction officer and broke the offi*834cer’s nose. Defendant was found guilty by a jury and sentenced as a second felony offender to a prison term of seven years, followed by five years of postrelease supervision. Defendant appeals.
