Benson, J.:

The controversy in this action is over the title to a narrow strip of ground containing a tier of lots in a town site immediately south of the north line of the southwest quarter of the southeast quarter of a section. The plaintiff claims the entire forty-acre tract except railroad grounds in the south part of it. The defendants severally claim title in the lots under tax deeds, and quitclaim deeds from a former owner of the whole tract.
