Welchman v. Wood
Utah Supreme Court
1Opinion of the Court
McDonough, justice.
Plaintiffs sued defendants, real estate broker and its agent, to recover real estate commission paid incident to the exchange of real properties, or in the alternative for damages for breach of contract in connection therewith. From summary judgment against them plaintiffs appeal.
The summary judgment was entered upon the basis of the pleadings and the deposition of plaintiff Arnell H. Welchman. On a motion for summary judgment the court is obliged to view the evidence in the light most favorable to him against whom it is directed, and such is our duty on appeal.
