On July 14 and 16, 1997, the Court, sitting without a jury, heard the first phase of the trial of this action brought by Plaintiffs, Robert LaFerriere, L L Associates (hereinafter "plaintiffs") and R R Associates1 against defendants, City of Providence and Providence Water Supply Board (hereinafter the "City") essentially alleging a taking and a breach of contract arising out of certain water rights taken for the creation of what is now the Scituate Reservoir.
