Appeal from judgment of the General Term of the-Supreme Court, in the first judicial department, entered upon an order made March 24, 1887, which affirmed a judgment in favor of defendant, entered upon a decision of the court on trial at the Circuit. The nature of the action and the facts are sufficiently stated in the opinion. No lawful discharge of this plaintiff was shown “ upon the 19th day of January,, 1885, at the regular meeting for that month.”

The plaintiff, on or about the first day of January, 1857, went into the service of the defendant as secretary, at the yearly salary of $1,500 ; his salary, from time to time changed, was, oil the first of January, 1884, increased to $4,500 a year. He continued as such secretary in the service of the defendant at that annual salary until January 19, 1885, when he was, by the board of directors of the defendant, removed from the office of secretary.
