The plaintiff is a domestic corporation licensed as a real estate broker, pursuant to the laws of the State of New York. On April 27, 1923, the decedent, Martha A. Gaines, was the owner of a parcel of real property, consisting of an apartment house, situate at the corner of Jane street and Eighth avenue in the borough of Manhattan, New York city.
