This cause came on to be heard upon the appeal, the transcript of the docket, journal entries and original papers of the Hamilton County Municipal Court, and the briefs and arguments of counsel.

On February 11, 1993, defendant-appellee, Michael R. Benner, was arrested and charged with menacing by stalking, a violation of R.C. 2903.211, after a complaint was filed in the Hamilton County Municipal Court.
