In this case, the appellants, eighty-two skilled nursing facilities that provide Medicare services (“Providers”), seek reimbursement under the Medicare Act, Title XVIII of the Social Security Act, 42 U.S.C. §§ 1395-1395ccc (1982 & Supp. V 1987), for services furnished to Medicare beneficiaries. The Secretary of Health and Human Services (“Secretary”) ruled that, pursuant to existing agency regulations, the “interest offset” rule, see 42 C.F.R. § 413.153 (1988), and the “equity capital exclusion”…
