The appellant was a candidate for the office of sheriff of Green county at the November election, 1901. His name was regularly placed upon the official ballot for that office. He received forty-two votes. The appellee, Ben F. Loy, was not a candidate for the office of sheriff-, and his name was not printed upon the official ballot which the county clerk furnished the officers of election in that county.
