This is a proceeding by certiorari to review the. determination of the Public Sei-vice Commission, first district, denying an application of the relator for permission to issue stock and bonds, and to execute a mortgage of all of relator’s properties, franchises and rights. The purposes to which the relator seeks to apply the capital to be derived from the sale of the stock and bonds are set forth in its petition as follows :(a) To secure or retire the present issue of bonds.(b) The acquisition of property situate in the city of Mew York upon which to erect power houses and…
